Non-Resident Nepali Association Hong Kong (NRNA HK) - Terms and Conditions
1. Introduction
This document outlines how the Non-Resident Nepali Association (NRNA) collects, processes, uses, discloses, transfers, and stores information about its members to provide and administer NRNA services. Membership of the NRNA is personal and only available to persons qualifying as Non-resident Nepalis as per the official definition outlined in the association's statute.
2. Statement of Intent
As a registered association, we take our responsibility to safeguard your information very seriously and use your information solely in service of our mission. The goal is to bring a sense of belonging to one big umbrella through service offerings that exclusively cater to the aspirations of the diaspora Nepali community.
3. Legal Status and Governing Law
3.1 Legal Status: The Non-Resident Nepali Association Hong Kong is a society legally registered in Hong Kong under the Societies Ordinance (Chapter 151, Laws of Hong Kong).
3.2 Governing Law: These terms and your membership with NRNA Hong Kong are governed by the laws of the Hong Kong Special Administrative Region.
3.3 Personal Data (Privacy) Ordinance: NRNA Hong Kong is committed to protecting your personal data in accordance with Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO"). All personal data collected from you will be handled in compliance with the six Data Protection Principles of the PDPO.
4. Validity and Benefits of Membership
Membership is valid for two years after a successful verification process. A single membership card is issued that is valid globally and in the member's country of residence. With a valid membership, members enjoy a gateway to a common platform of the global Nepali community and can stay connected with Nepal & Nepali Society. Members become part of a network with people having similar interests and can enhance their capacity to negotiate with governments & organizations.
5. Data Collection and Use of Personal Data
When a new member registers, we collect basic information (name, city of residence, etc.), documentary evidence to verify identity (passport, citizenship, etc.), and contact information (email, phone number). We use this personal information to create, develop, promote, administer, and deliver services from the association. From time to time, we may use your personal information to send you important notices, such as changes in our terms, conditions, and policies.
5.1 Personal Information Collection Statement (PICS): Before you provide any personal data, you will be presented with a Personal Information Collection Statement that explains the specific purposes for which your data is being collected, the classes of persons to whom it may be transferred, and your rights to access and correct the data.
5.2 Collection of Identity Documents: For the purpose of verifying your eligibility for membership, we may require a copy of your government-issued identification, such as your Hong Kong Identity Card or passport. This data is considered sensitive and will be used solely for verification, stored securely, and deleted in accordance with our data retention policy. You are not obligated to provide this information, but failure to do so may result in an unsuccessful membership application.
5.3 Collection of Facial Data: For identity verification and to prevent fraudulent applications, we may require you to provide a facial image. This is sensitive biometric data under the PDPO. By providing your facial data, you give your explicit consent for it to be used for the sole purpose of verifying your identity against your provided identification documents. This data will be stored securely with restricted access and will be permanently deleted from our systems in accordance with our data retention policy.
6. Cross-Border Data Transfer
6.1 Consent to Transfer: Please be aware that the NRNA membership management system is hosted on Microsoft Azure cloud servers. By applying for membership, you acknowledge and explicitly consent that your personal data, including any identity documents and facial data you provide, will be transferred to, processed, and stored in the United States. You understand that the data protection laws in the United States may differ from those in Hong Kong.
7. Data Sharing and Confidentiality
7.1 Non-Disclosure with NRNA ICC: For the purposes of global membership coordination and administration, necessary member data will be shared with the NRNA International Coordination Council (ICC). This data sharing is governed by a signed Non-Disclosure Agreement (NDA) between NRNA Hong Kong and the NRNA ICC. The NDA legally obligates the NRNA ICC to use your data solely for official NRNA purposes and prohibits its disclosure to any unauthorized third parties.
8. Your Data Subject Rights in Hong Kong
8.1 Right to Access and Correct Data: Under the PDPO, you have the right to request access to the personal data that NRNA Hong Kong holds about you and to request the correction of any data that is inaccurate.
8.2 Data Access Requests: All requests for access to or correction of your personal data should be made in writing and addressed to the General Secretary of NRNA Hong Kong at the following email address: nrnahk@gmail.com. We will handle your request in accordance with the requirements of the PDPO.
9. Member Conduct and Responsibilities
9.1 Code of Conduct: As a member of NRNA Hong Kong, you agree to abide by the association's constitution and code of conduct. You shall act in a manner that upholds the integrity, reputation, and objectives of the NRNA.
9.2 Misconduct: Any behaviour deemed detrimental to the association, including but not limited to harassment, fraudulent activity, or actions that bring the NRNA into disrepute, may result in disciplinary action.
10. Cancellation and Termination of Membership
10.1 Voluntary Cancellation: Members may cancel their membership at any time by providing written notice to the General Secretary of their respective National Coordination Council (NCC). Membership fees are non-refundable.
10.2 Termination by NRNA: In the event of misuse of the membership, damage to the reputation of the association, or wilful harm caused, NRNA reserves the right to exclude the member(s) in question. Such misuse may include, but is not limited to, behaviour which is troublesome or shows a lack of respect towards the association or its partners, criminal actions, or actions that are generally regarded to be unethical or contrary to these terms. The member will be notified in writing and given an opportunity to respond before a final decision is made.
11. Liability
11.1 Limitation of Liability: NRNA Hong Kong is a non-profit social organization. To the extent permitted by law, the association and its office bearers shall not be liable for any loss or damage suffered by a member in connection with their membership or participation in association activities.
12. Language
12.1 Bilingual Policy: These terms are provided in both English and Chinese. In the event of any discrepancy or inconsistency between the two versions, the English version shall prevail.

3. 法律地位及管轄法律
3.1 法律地位: 非居住尼泊爾人協會香港是根據香港法例第151章《社團條例》在香港合法註冊的社團。
3.2 管轄法律: 本條款及您在 NRNA 香港的會籍受香港特別行政區法律管轄。
3.3 個人資料(私隱)條例: NRNA 香港致力於根據香港法例第486章《個人資料(私隱)條例》("PDPO")保護您的個人資料。所有從您那裡收集的個人資料將按照 PDPO 的六項保障資料原則進行處理。
4. 會籍的有效性及福利
會籍在成功驗證後有效期為兩年。會員將獲發一張全球通用及其居住國有效的會員證。憑有效會籍,會員可享用全球尼泊爾社群的共同平台,並與尼泊爾及尼泊爾社會保持聯繫。會員將成為一個擁有相似興趣人士網絡的一部分,並能提升他們與政府及組織協商的能力。
5. 資料收集及個人資料的使用
新會員註冊時,我們會收集基本資訊(姓名、居住城市等)、用於驗證身份的證明文件(護照、公民身份證明等)以及聯絡方式(電郵、電話號碼)。我們使用這些個人資料來創建、發展、推廣、管理和提供協會的服務。我們可能會不時使用您的個人資料向您發送重要通知,例如我們的條款、細則和政策的變更。
5.1 收集個人資料聲明 (PICS): 在您提供任何個人資料之前,您將會收到一份《收集個人資料聲明》,其中解釋了收集您資料的具體目的、資料可能轉移給哪些類別的人士,以及您查閱和更正資料的權利。
5.2 身份證明文件的收集: 為驗證您的會籍資格,我們可能要求您提供政府簽發的身份證明文件副本,例如您的香港身份證或護照。此類資料被視為敏感資料,將僅用於驗證目的,並會被安全儲存,及根據我們的資料保留政策予以刪除。您沒有義務提供此資訊,但若未能提供,可能會導致您的會籍申請不成功。
5.3 面部數據的收集: 為進行身份驗證及防止欺詐性申請,我們可能要求您提供面部圖像。根據 PDPO,這屬於敏感的生物識別資料。提供您的面部數據,即表示您明確同意我們將其僅用於核對您所提供的身份證明文件以驗證您的身份。此數據將被安全儲存,訪問權限將受嚴格限制,並會根據我們的資料保留政策從我們的系統中永久刪除。
6. 跨境資料轉移
6.1 同意轉移: 請注意,NRNA 的會員管理系統託管於 Microsoft Azure 的雲端伺服器,其數據中心位於美國東部。申請會籍即表示您知悉並明確同意您的個人資料,包括您提供的任何身份證明文件和面部數據,將被轉移到美國進行處理和儲存。您理解美國的資料保護法律可能與香港的法律有所不同。
7. 資料共享與保密
7.1 與 NRNA 國際協調委員會的保密協議: 為進行全球會籍協調和行政管理,NRNA 香港可能會與 NRNA 國際協調委員會 (ICC) 共享必要的會員資料。此資料共享受 NRNA 香港與 NRNA ICC 之間簽署的嚴格保密協議 (NDA) 的約束。該保密協議在法律上規定 NRNA ICC 僅可將您的資料用於 NRNA 的官方目的,並禁止向任何未經授權的第三方披露。
8. 您在香港的資料當事人權利
8.1 查閱和更正資料的權利: 根據 PDPO,您有權要求查閱 NRNA 香港持有的關於您的個人資料,並有權要求更正任何不準確的資料。
8.2 查閱資料的要求: 所有查閱或更正您個人資料的請求,均須以書面形式向 NRNA 香港秘書長提出,電郵地址為:nrnahk@gmail.com。我們將根據 PDPO 的要求處理您的請求。
9. 會員行為與責任
9.1 行為守則: 作為 NRNA 香港的會員,您同意遵守協會的章程和行為守則。您的行為應維護 NRNA 的誠信、聲譽和目標。
9.2 不當行為: 任何被視為對協會有害的行為,包括但不限於騷擾、欺詐活動或令 NRNA 聲譽受損的行為,都可能導致紀律處分。
10. 取消及終止會籍
10.1 自願取消: 會員可隨時以書面形式通知其所屬的國家協調委員會 (NCC) 的秘書長取消其會籍。會費不予退還。
10.2 由 NRNA 終止: 如果會員濫用會籍、損害協會聲譽或蓄意造成傷害,NRNA 保留將其開除的權利。此類濫用行為包括但不限於對協會或其合作夥伴造成困擾或缺乏尊重的行為、犯罪行為或通常被認為不道德或違反本條款的行為。在作出最終決定前,會員將收到書面通知並有機會作出回應。
11. 責任
11.1 責任限制: NRNA 香港為一非牟利社會組織。在法律允許的範圍內,本會及其幹事對會員因其會籍或參與本會活動而遭受的任何損失或損害概不負責。
12. 語言
12.1 雙語政策: 本條款提供英文和中文兩個版本。如兩個版本之間存在任何差異或不一致之處,概以英文版本為準。
